The decree issued by Junta de Andalucia that took under control the apartments rented for tourists now obliges every involved owner to register in Registro de Turismo. This introduces a new business for those who see tourists as more profitable renters. Let’s find out if your case fits this description:

  • What is touristic accomodation?

That is, all the real estate in Andalucia that gives accommodation at a price fixed by the owner (landlord) and offers it on touristic online platforms or travel agencies. According to the Delegation of Tourism of the Board in Malaga, the property advertisers that connect landlords with travelers have to register this property as the touristic accommodation. This rule does not affect tourist rental homes located in rural areas, which are governed by an already established decree. Nor does it affect those who have three or more dwellings destined to these ends within a radius of one kilometer. In this case they are regulated by the decree of Tourist Apartments.

  • What if the apartment is rented for 3 summer months for fortnights or weeks?

It still has to be registered in Registro de Turismo. The decree leaves out only the dwellings rented for more than 2 months by the same person, even if it is the hot season and was settled without the advertisers.

  • What are the requirements for the touristic housing?

The occupancy license, ventilated rooms, air conditioning system in the living rooms and bedrooms, a first aid kit, touristic area guide, cleaning services before and after the renters, bedsheets, appliances, a contact telephone and the community rules in order not to cause any inconveniences to the neighbors. The maximum number of renters must not exceed 15 people.

  • What are the required documents?

The process is as easy as entering the website of the Ministry of Tourism of the Regional Government of Andalucia and clicking on Registro de Turismo and print out the declaration. The declaration must be filled out and signed to be delivered to the Delegation of Tourism in Malaga. This activates the registration and therefore, allows you to start the business. Your property will be identified with a code as the touristic housing and be saved as such on the online platforms.

  • How is the touristic housing paid?

The housing is taxed including the income earned by the development of the activity as earnings on the annual income tax return. You do not need to register as a self-employed person, it does not involve any fees, nor does it involve VAT tax if the person who exploits it is the owner. The tourist rental is an accommodation service, not an establishment.

  • Is it possible to rent just a room in the house?

It is possible to do so if the owner of the property inhabits the flat in which he wants to rent rooms. The procedures and documentation are the same as for the whole house. In this case the owner will also receive a registration number with which to advertise this service in the online platforms.

  • Do I need to sign contracts with each renter and ask the ID for the police record?

The rules oblige to sign a contract with each tenant, even if it stays one night. In addition, it must be kept for one year in case it is required by the Tourism inspectors. This document must include the name of the person or entity that operates the housing, the alphanumeric registration code in the Tourist Registry of Andalusia, the number of occupants, the dates of entry and exit, the total payment and the phone number provided to the client to report incidents. As for the invoice, the owner can only issue a receipt for the payment with the agreed price. And for safety reasons, the renters should have their IDs in order to fill in the corresponding entry part, which is yet to indicate the route of communication to the police registry. In the case of hotels and apartments is done by telematic.

  • What are the entry and exit hours?

The regulations state that if the specific time is not agreed, the entrance hour is at 4 p.m. and the exit is at noon.

  • What if a landlord wants to rent three or more homes located within a radius of one kilometer?

Those who rent three or more apartments in the same building or in blocks that are within a radius of one kilometer must be regulated by the decree of Tourist Apartments. This standard is more demanding as it requires an opening license. Likewise, once it is considered a tourist establishment, the taxation is different from that of a tourist service such as renting a property. Therefore, according to the Board, the owner of three or more homes must register as a self-employed to exploit this activity and be governed by the tax requirements of the person who conducts a business.
